02. PURPOSE AND SCOPE
These terms and conditions govern access to, browsing of and purchases made through the online store.
By placing an order, the customer agrees to these terms and conditions, without prejudice to any rights granted under applicable consumer protection legislation.
These terms apply to purchases made by individual consumers. Orders placed by companies or professionals in the course of their business activities may be subject to specific commercial terms expressly agreed between the parties.
03. PRODUCTS AND MADE-TO-ORDER PRODUCTION
The products available in the store are original pieces developed by the studio. Each product includes a description of its characteristics, materials, finishes, dimensions and other relevant specifications.
All products are made to order. This means that production begins once an order has been placed and payment has been confirmed. Products are therefore not necessarily available for immediate dispatch.
This production model allows each piece to be manufactured individually, avoiding unnecessary stock and adapting the manufacturing process to the specific characteristics of each product.
Estimated production and delivery times are indicated on the relevant product page. Where expressly stated, these timeframes are indicative. The studio will inform the customer of any circumstances that may significantly affect the expected delivery date.
Due to the nature of certain materials and manufacturing processes, slight variations in colour, texture or finish may occur between individual pieces. Such variations will not affect the essential characteristics of the product or its conformity with the description provided.
04. PRICES AND TAXES
All prices are expressed in euros (€).
The applicable prices are those displayed in the store at the time the order is placed. Unless expressly stated otherwise, prices displayed to individual consumers include all applicable taxes.
Any shipping costs will be displayed separately before the purchase is completed.
International orders may be subject to additional taxes, customs duties or import charges in the destination country. Where legally applicable, these costs shall be borne by the customer. Such charges will be communicated before purchase whenever they can reasonably be determined.
05. ORDERING AND PAYMENT
To place an order, customers must select the desired product, choose any available options and provide the information requested during the checkout process.
Before confirming the purchase, customers will be able to review the selected products, prices, applicable charges and delivery details, and correct any errors.
Final confirmation of the order constitutes an acknowledgement of the obligation to pay.
Available payment methods are those displayed during checkout. Payment must be completed for the order to be confirmed and proceed to production.
Once the order has been received, the customer will receive an email confirmation containing the relevant order details.
The studio may contact the customer if any additional information or clarification is required in relation to the order.
06. PRODUCTION, SHIPPING AND DELIVERY
Once payment has been confirmed, the order will proceed to the relevant production stage.
Estimated production and delivery times are indicated on the product page or during checkout. Unless a different period has been expressly agreed, delivery shall take place without undue delay and, in any event, within the statutory maximum period of 30 calendar days from the conclusion of the contract.
If the studio is unable to meet the agreed delivery timeframe, the customer will be informed and the rights provided under applicable legislation will apply, including, where appropriate, the right to terminate the contract and receive a refund of the amounts paid.
Orders will be shipped to the address provided by the customer. Customers are responsible for ensuring that their delivery details are accurate and complete.
Customers are encouraged to notify the studio as soon as possible of any visible damage during transport or delivery errors. Such notification does not affect or limit any statutory rights they may have.
07. RIGHT OF WITHDRAWAL
Under Spanish legislation, consumers making distance purchases generally have the right to withdraw from the contract within 14 calendar days of receiving the product, without having to provide a reason.
Exception for personalised or custom-made products
The right of withdrawal does not apply to products made to the consumer's specifications or clearly personalised, in accordance with Article 103(c) of Royal Legislative Decree 1/2007.
This exception applies only to orders that genuinely meet these legal requirements. The fact that a standard product is manufactured on demand does not, in itself, exclude the right of withdrawal.
How to exercise the right of withdrawal
To exercise this right, customers must notify the studio of their decision unequivocally by sending an email to info@ignaciodeltoro.com, stating their order number and the products concerned.
The product must be returned within a maximum of 14 calendar days from the date on which the withdrawal decision was communicated.
Unless otherwise indicated by the studio, the direct costs of returning the product shall be borne by the customer, provided that this information was disclosed before the purchase.
Customers shall only be liable for any diminished value of the product resulting from handling beyond what is necessary to establish its nature, characteristics and functioning.
Refunds
In the event of a valid withdrawal, the studio shall reimburse all payments received, including the cost of standard delivery corresponding to the least expensive delivery option offered.
The refund shall be issued within a maximum of 14 calendar days from the date on which the studio is informed of the customer's decision to withdraw. However, the studio may withhold the refund until the returned goods have been received or the customer has provided evidence of having sent them back, whichever occurs first.
Refunds shall be made using the same payment method used for the original transaction, unless expressly agreed otherwise.
08. LEGAL GUARANTEE AND LACK OF CONFORMITY
All products sold to consumers are covered by the statutory legal guarantee of conformity established under applicable legislation.
For new goods, the studio shall be liable for any lack of conformity that becomes apparent within three years from the date of delivery.
If a product presents a lack of conformity, the customer shall be entitled to request that it be brought into conformity through repair or replacement, under the terms established by law. Where these remedies are unavailable or inappropriate, the customer may be entitled to a price reduction or termination of the contract in accordance with applicable legislation.
This legal guarantee is separate from any aesthetic variations inherent to the materials or manufacturing processes, provided that such characteristics have been adequately described and the product conforms to the agreed specifications.
Nothing in these terms shall affect the customer's statutory rights in relation to defective, damaged or non-conforming products.
09. LIABILITY
The studio undertakes to supply products in accordance with the characteristics and conditions described in the online store.
Customers are responsible for providing accurate information for order processing and delivery, and for using and maintaining products in accordance with their characteristics and any instructions provided.
Nothing in these terms shall exclude or limit any mandatory rights granted to consumers under applicable legislation.
10. INTELLECTUAL PROPERTY
All designs, photographs, images, texts, product names and other content displayed in the store are the property of Ignacio del Toro | Studio or are used with the appropriate authorisation.
Their reproduction, distribution, modification or commercial use without the prior express consent of the relevant rights holders is prohibited, except where permitted by applicable law.
The purchase of a physical product does not constitute a transfer or assignment of the intellectual property rights in its design.
11. DATA PROTECTION
Personal data provided during the purchasing process will be processed for the purposes of managing orders, processing payments, arranging deliveries and complying with applicable legal obligations.
The processing of personal data is governed by the Privacy Policy available on the website.
12. APPLICABLE LAW AND DISPUTE RESOLUTION
These terms and conditions shall be governed by the applicable Spanish and European legislation.
In the event of a dispute, the parties may seek to reach an amicable resolution by contacting the studio directly.
Where the customer qualifies as a consumer, jurisdiction shall be determined in accordance with the applicable consumer protection legislation.
13. SCOPE OF APPLICATION
These terms and conditions apply exclusively to purchases made through the online store of Ignacio del Toro | Studio.
Commissions, projects and orders arranged directly with the studio by email or through other communication channels shall be governed by the specific commercial terms and conditions expressly agreed between the parties. These may include product specifications, quotations, production schedules, payment arrangements and delivery conditions.
In such cases, the specific terms accepted by both parties shall prevail over these online store terms in respect of the matters they expressly regulate.
In all cases, transactions shall remain subject to applicable legislation, including any mandatory consumer rights.
